Mandatory disclosures in accordance with Section 43 of the Electronic Communications and Transactions Act 25 of 2002 (ECTA)

Section 43 of the Electronic Communications and Transactions Act 25 of 2002 requires websites that offer goods or services to consumers to disclose certain information. The following disclosures are provided in compliance with this requirement.

3. Description of Goods and Services

Mimosie is an online advertising and connection platform that connects dress owners with potential renters in the Stellenbosch student community. The platform allows users to:

  • Browse dress listings from other users
  • Create and publish listings for dresses they own and wish to hire out
  • Communicate with other users via in-app messaging
  • Contact dress owners via WhatsApp (if the owner has opted in)

Mimosie is a connector platform only. We do not participate in, manage, or guarantee any rental transactions, payments, or logistics between users. All arrangements are made directly between users at their own risk.

4. Price of Services

Browsing and messaging:

Free for all registered users.

Listing fees:

Currently in a promotional period during which a limited number of listings are free. Once the promotional allocation is exhausted, a once-off listing fee applies per dress uploaded. Current pricing is displayed at the time of upload.

All prices are displayed in South African Rand (ZAR) and are inclusive of any applicable taxes unless otherwise stated.

5. Payment Methods Accepted

Listing fees are processed via Paystack, which supports the following payment methods:

  • Credit and debit card payments (Visa, Mastercard)
  • Other payment methods as supported by Paystack at the time of transaction

Mimosie does not store, access, or process card or banking details directly. All payment data is handled securely by Paystack in accordance with PCI-DSS standards.

6. Manner of Payment

Listing fees are charged as a once-off payment at the time of uploading a dress listing, where applicable. Payment must be completed before the listing is submitted for review. No recurring or subscription charges apply.

7. Return and Cancellation Policy

In accordance with Section 44 of the Consumer Protection Act 68 of 2008 (CPA), you have the right to cancel an electronic transaction within 7 business days for a full refund.

However, because Mimosie's service involves publishing your listing immediately upon payment and approval, the cooling-off period is waived once your listing goes live on the platform. You will be asked to confirm this waiver explicitly before payment is processed.

If your listing has not yet been approved and published, contact us within 7 business days of payment at mimosieza@gmail.com to request a refund. Refunds are processed within 5–7 business days via the original payment method.

9. Codes of Conduct

Mimosie has not currently subscribed to any industry codes of conduct beyond the applicable legal requirements under ECTA, POPIA, and the Consumer Protection Act.

If you have a complaint about our services, we encourage you to contact us directly first so we can attempt to resolve the matter:

If we are unable to resolve your complaint, you may escalate it to:

  • The Information Regulator (for data protection complaints)
  • The National Consumer Commission (for consumer protection complaints)
