Takedown Policy

In accordance with Chapter XI of the Electronic Communications and Transactions Act 25 of 2002 (ECTA)

Mimosie takes the rights of content owners and individuals seriously. This Takedown Policy sets out the procedure for notifying us of content that you believe infringes your rights, and how we will respond to such notices, in accordance with ECTA Chapter XI.

1. What Constitutes Infringing Content

You may submit a takedown notice if you believe content on Mimosie:

  • Infringes your copyright or other intellectual property rights (e.g., photos or descriptions copied without permission)
  • Defames you or contains false statements of fact about you
  • Violates your right to privacy by disclosing your personal information without consent
  • Contains unlawful content under South African law
  • Constitutes harassment, hate speech, or content targeting you personally

We do not remove content based on disagreement or preference. Your notice must identify a specific legal basis for the removal.

2. How to Submit a Takedown Notice

Send your takedown notice to mimosieza@gmail.com with the subject line: TAKEDOWN NOTICE.

Your notice must include all of the following:

  • Your full name and contact details: Your name, email address, and phone number so we can follow up with you.
  • Description of the infringing content: A clear description of the content you believe infringes your rights and the nature of the infringement.
  • Location of the content (URL): The specific URL(s) or location(s) on Mimosie where the infringing content can be found.
  • Your rights in the content: A statement describing why you have the right to make this complaint (e.g., you are the copyright owner, the subject of the content, or an authorised representative).
  • Statement of good faith: A declaration that you have a good faith belief that the use of the material described is not authorised by the rights holder, their agent, or the law, and that the information in your notice is accurate.
  • Signature: Your physical or electronic signature (typing your full name at the bottom of the email constitutes an electronic signature).

Important

Submitting a false takedown notice is unlawful and may expose you to civil or criminal liability. Please ensure your notice is accurate and in good faith before submitting.

3. Mimosie's Response Procedure

Upon receiving a valid takedown notice, we will:

  1. Acknowledge receipt of your notice within 2 business days.
  2. Review the notice to determine whether it meets the requirements set out above.
  3. Remove or disable access to the identified content within 5 business days of acknowledging the notice, pending investigation, if the notice appears valid on its face.
  4. Notify the user who posted the content that a takedown notice has been received and that their content has been removed pending investigation.
  5. Investigate the complaint and make a determination on the merits. We may request additional information from you or the content uploader.
  6. Communicate our decision to both parties once a determination has been made.

If a notice is incomplete or does not establish a valid legal basis for removal, we will notify you and may ask for additional information before taking action.

4. Counter-Notification Process

If your content has been removed in response to a takedown notice and you believe the removal was erroneous, you may submit a counter-notification to mimosieza@gmail.com with the subject line: COUNTER-NOTIFICATION.

Your counter-notification must include:

  • Your full name and contact details
  • Identification of the specific content that was removed and its previous location on the platform
  • A statement under penalty of perjury that you have a good faith belief that the content was removed as a result of mistake or misidentification
  • A statement consenting to the jurisdiction of South African courts for any dispute relating to the content
  • Your physical or electronic signature

Upon receiving a valid counter-notification, we will notify the original complainant. If the original complainant does not initiate legal proceedings within 10 business days of receiving the counter-notification, we may reinstate the removed content at our discretion.

5. Repeat Infringers

Mimosie has a policy of terminating accounts of users who are found to repeatedly infringe the rights of others. We may suspend or permanently terminate any account associated with repeated valid takedown notices.
